innocence might perish. On the ground of necessity
there is much more reason for putting
to death all) As to the power of necessity it
would be much stronger in the case of incurable
maniacs for disposing destroying of maniacs in this
manner, than for destroying the most dangerous
malefactor that ever yet existed. Ask men
why they will have capital punishment?
the answer is because in certain because cases nothing else will satiate their antipathy, against or because they have been used to
look upon it as necessary. Ask them why they
will have Juries? — because they have been
used to look upon Juries as necessary. To
be sure if they will have the one, they are
their best way is to take the other along with
it. One The one prejudice may serves to alternate the othe
mischief of the other. If men will swallow
poison, it may be necessary for them to follow
it by an unwholesome remedy. But so sure
as you let in capital punishment so sure you
spoil the whole system of procedure as far as
concerns the offences to which it is made applicable.
