Jury There can be no necessity of appealing to a
Jury from a judgment of acquittal
given by one Judge and confirmed after two
different hearings by two successive Judges. There
is no occasion to give can be no necessity in committing to an
unknown assemblage of ignorant and uneducated
men, the power of proscription. Those
who suppose take for granted that men of
this description can only err on the side of lonely are liable to no error but what is ion the side of lonely
must view with very partial eyes regard the sums
recorded in history the history of times present as well as past as well as those which are
passing before their eyes. How much innocent
blood was shed by juries in the reign of Charles 2d on the occasion of
the pretended Popish plots, by Juries, not a
drop of which would have been shed by any of
the Judges! even of that wicked time! And what chance would the Baron de Besenval have had with before a Jury
composed of the active citizens who sent
Foulon and Berthier to their long home?
