2. Second advantage. Preventing the suspicion of
partiality to which the character of a permanent Judge, howsoever
pure remains must remain exposed, if on the occasion of every question
that comes under his cognizance, and in favour of or disfavour
of any person subject to his jurisdiction the question
of fact is liable to receive its decision at his hands.
The Of the mischief here in question, no scarce
any part whatever ought to be considered as constituted by
the any feeling of personal uneasiness that may happen to
be experienced by the Judge. This individual uneasiness
is no other than what is inseparably attached to the sense
of moral responsibility: a sense in the acuteness of which on the
part of the Judge the most efficient security for good behaviour

The Judge too is but one or a few: the people
whose interests in their quality of suitors actual or possible
are at stake, are millions.
The real part of the mischief here in question brought to view
consists in the danger of alarm liable to be produced
by this suspicion in the breasts of the people: the alarm
in other words the sense of insecurity – a state of perpetual
uneasiness which from by such a cause is liable to be capable of being
propagated to any an indefinite extent.
