French Parliaments an inadequate succedaneum to Jury trial
gives to the French constitution the advantage over every other
continental one.
But though the principal part of the benefit, the constitutional
is but part of the aggregate benefit: and when
this is deducted, still, I believe it will appear, that
with a view to the ends of justice independently of constitutional
considerations, the civil causes are not capable of being carried
on so well, or so much to the satisfaction of the people without Jury trial, as with the help of it
and by means of it. But this the formation of this general
conclusion must wait the previous examination of the several distinguish
features distinguishable in Jury trial, as actually
carried on in civil matters under English judicature:
viz. that the requisite mass of improvement may not be attempted to be drawn
from so arduous and recondite obscure a source, untill it be
seen the for in what proportion it may be capable
of being drawn from other sources more readily accessible.
