As to sinister interest, the shapes in which it is liable
to lurk in the breast of a Juryman are innumerable: the
above is but a single one brought in view for the mere
purpose of illustration.
On the other hand, the Jury being a numerous
body, member by custom twelve, sinister interest
if confined in its operation to one such bosom, or in one shape or other though it should occupy
any number, yet, if that number be not sufficient
to command the verdict, is a harmless and without effect.
True: but is though confined within a single bosom, suppose
the sinister bias, by whatsoever class species of motive produced –
self regarding interest, social affection or dissocial – strong
enough to command the verdict? – Now this is among
the effects of the forced concord and pretended unanimity:
– but of that in its place.
