Add case of Special Jurymen
If the station in life were too high the mischief would
in general view be that of an aristocracy, but the nature and effects of this
easily supposed and but difficulty realizable mischief would be
very difficult to divine.
Take the highest rank for illustration example: and suppose
them (Jurymen) to be all Lords.
To judge For judging what would be the result in this supposed
but exaggerated case, the shortest and clearest course is to
observe what in that high station actually does take
place where judicature is the function to be exercised.
In the first place the supposed Lords Jurymen being too
powerful to be forced compelled by law to attend, as actual Jurymen actually
are, would not attend: so that here the supposition
vanishes at the first step: and the proof is that in the
judicatory of the Lords House no man unless by accident does attend, but
the three Lords who, to set the business a going give validity to the proceedings must attend,
and who are all every one of them in some way or other
paid for attendance, and every one of them, in some way
or other obliged to give it pay that attendance.
