In the application made of it by under English law
it has another feature of savage barbarity from which
under the application made of it under Roman law
it is free. Under Roman law it is never applied to
more than one man, at a for the same cause and at the same time. Under English
law it is never applied to fewer than twelve men at a
time.
Under Roman law it is never applied to any man
but on the ground of or at any rate imputed criminality delinquency
and that and that in the highest degree.
Under English law it is applied without
or in a fit of blind and unblinking
barbarity without to twelve men in the lump without
consideration any fixt determinate object – without consideration and
had either of the causes or effects.
Of whence is it expected that they should deliver declare upon
such an opinion opposite to their real one? of the
majority or the minority greater or the smaller number? Shall it be said, – of the
smaller number: shall it be said that on the part
of the smaller number to differ from the opinion, and thence resist the will of the greater,
is to betray in culpable obstinacy, for which the
punishment is done. For the argument sake, Be it so, and suppose one
such obstinate person, and no more. Here then is
one culpable person individual punished in this manner for his
guilt: and along with him, and by his procurement, eleven
others punished in the same manner for their innocence.
