Of the force strength and extensive prevalence of this propensity there can not be a more
striking exemplification, nor at the same time a more
convincing proof of than that which is afforded in the
legislative body in its resignation to the guidance of
men of professional lawyers in regard to so far as concerns all such parts of the
field of law as are understood to fall lie more particularly
within under their cognizance. To anyone who
by one motive or another is not predetermined on this occasion to turn aside
from the truth, nothing will be more clear than that to the
extent of this vast portion of the field of legislation the interest
of the man of law is in a state of exact opposition
and irreconcilable hostility to the interest of the rest of the
community. But by this conviction, even when attained,
men non-lawyers are not stopped from recognising confiding their own interest
and that of the country with the most proverbial implicit designation acquiescence
to the mercy of those their natural and irreconcilable adversaries. Why? – because,
the interest which any given non-lawyer has
in making the law better than it is, is not so strong as
that which every lawyer in the station situation in question has in
keeping preserving it from being made better, and employing such
favourable opportunities as may occur for making it worse,† † See Ch. Causes – Jury trial an additional source of business and
because no non-lawyer can flatter himself with being
able to penetrate and see through the clouds of dust by in
which every portion of the lawyer part of field of law has been so
diligently and successfully enveloped.
