Whatsoever may be the plausibility of this plan, a very simple short
consideration will suffice to pulverize for the rejection of it. That which
a man is understood to be bound compelled to do, he is either
not censured at all for doing, or at any rate less censured
that if he were free to do or not to do it at pleasure.
Make it matter of legal obligation to the Judge to resist
as above the verdict which is not conformable to his own opinion
a the Jury which howsoever thwarted and displeased with
his opposition resistance, will at any rate be more disposed to excuse
it, compulsory as it is and as he will have declared
it to be, than if it were already free.
