The weakness if in Jurymen is the power & of the power.
As in Parliament the same fallacies are still produced, Lawyers
& still with this same effect.
§. 5. 4.
§. 5. 4. Fourth inseparable disadvantage – exposure to
deception delusion and consequent misdecision from the influence
of rhetorical fallacies.
Cullibility (or gullibility – either might serve) is
the and more impressive and expressive
name given to the sort of weakness here mentioned
in familiar discourse conversation or in such written compositions
in which the tone of conversation is purposely assumed.
To be liable to be led astray and susceptibility to the sinister influence if imposed upon
by fallacies is a weakness to which unhappily not
peculiar to Juries.
In every situation station of life, man is liable exposed to
deception even when alone, and with full time and when by solitude examples
from disturbance and interruption, with full time to
give to each part of the subject such parts intensity
and as well as length of attention as in respect of importance
and difficulty taken together, it may appears to merit.
In every station of life man is exposed to deception
partly from different causes sources, partly in a higher degree
from he same sources as those from which it is liable he stands
exposed to receive it when alone.
Thus far is common-place. But what is
very different from non common-place is – that deception the sources
from which or efficient causes by which deception is liable to arise be produced have to
a certain degree been found to a considerable extent capable of being diluted distinguished,
classed and designated and separately denominated each of them by an
appropriate name.
