The list of fallacies, supposing it made up, the list of fallacies
would furnishing be capable of furnishing an appropriate and useful part of the
furniture of every Court (not to speak of others) in which that contained
within it a Jury box: A wand to be occasionally so many
rates of distinguishable fallacies characterised by their respective
names, so many rules marking reprobating the use of
them respectively as an irregularity so many unlawful arms weapons, which the the Advocate
is warned to avoid employing, and the Judge to
guard the judgment of the Jury against, if employed.
A wand to be occasionally by the hand of the Judge pointed to the rule regarded supposed
to be infringed would supersede the necessity of
those rules of Order, Order, by which in assemblies
of a higher class Order is first broken before it is
preserved.
High as well as low, it is an object of concern
with those who travel through turnpikes that not to
pay on that occasion anything more than the law
makes necessary; accordingly to the most refined task
there is nothing ridiculous in the idea of the instruction
thus afforded presents to such idea emotion sentiment as that of the ridiculous ridicule.
If in the breasts of those on whom it depends an
interest equally decided and extensive general recommended were understood to
urge recommend the guarding of the judges of Juries from the delusive effect of
rhetorical fallacies a Table indicative of those fallacies
would no more be in danger of being pronounced ridiculous
than a Table of turnpike rates. But unhappily in the
eyes of those by eyes of those by whom expressions of being declared here have been made, and on whose breath justice depends, an arrangement is
ridiculous – not in
the inverse but in the
direct ratio of its tendency
to promote justice.
