§. 6. 5. Fifth inseparable disadvantage – Want of
sufficient aptitude fixt principles for settling the quantum of compensation
The comparative unfitness of an occasional and unexperienced
and judicatory with relation to this particular
article in the list of judicial functions, has already
been brought to view† †: and on the same occasion
the want of fixt principles or rules for their
guidance in the exercise of this function has been was
mentioned stated as the cause of that unfitness.
The framing of a set of rules for this purpose
by legislative authority was on that same
occasion mentioned as a work task the execution
of which seemed indispensably necessary to the due
discharge exercise of this function.
This being the case But if in the task of framing
such set of rules there be nothing naturally impracticable,
the disadvantage, whatever it be, which
this species of judicatory labours under at present
for want of such rules, is not at any rate
(it may be said) among the disadvantages
inseparable from its nature.
