By a system of fraud artifice and imposture, the
various manifestations of which may when combined taken
in the aggregate be comprehended included comprized under the common denomination of technicalism
– by fiction, by nullification by fiction, antiquated
language, surplusage, absurdity and nonsense, the founders
and upholders of the system of procedure of which
Jury trial forms a part, have succeeded to a great
extent in rendering giving this unintelligibility to
transactions thus which if when represented without disguise
nothing would need be more generally intelligible
thereby causing the Jury to suffer to be given
under their name a decision verdict in the formation of
which their understanding had found it impossible to
bear a part, regarding looking at all the while, as an object
of admiration and reverence bordering on almost adoration, a system
of fraud and imposture which if viewed in its proper true
colours light, would excite have excited no other emotion than
that of indignation and contempt.
