Special Jury allowance
The last expedient I shall bring to view mention for alleviating
the burthen to Scotch jurors, is comes under the head
of compensation.
The burthen imposed on Jurors is distinguishable may be cast
under three heads into three parts – corresponding to time spent in Court,
journeys and demurrage, whereof to the purpose of expence,
demurrage and time spent in Court and may be considered as
an included in demurrage.
Of demurrage the expence will be an uniform
quantity, and that ascertainable to a practical sufficient degree of
exactness without difficulty: maintenance per head board and lodging per
day, so much. This expence might according to
custom be thrown upon the parties, or according to reason
and justice upon the public, which without vexation
or expence engage that protection for which the aggregate
body of suitors are made to pay in both shapes
at so dear a rate.† † Protest against Land-Taxes.
The smaller the number of Jurors required per Jury for
each Jury, the less of course would be the amount burthen
compensation as above, on whatsoever fund imposed.
