Ch. Causes of the attachment of the people in England to
Jury trial so far as concerns civil causes cases.
In Natural, In the mouth of one who recommends is occupied in
recommending Jury trial to to the people in Scotland as fit to be adopted into the
practice procedure of their Courts judicatories, a natural and surely one that certainly
argument, one that surely certainly an irrational one
is taken deduced drawn from the attachment so universally manifested f by in
England for an the institution by their people fellow subjects
on the other side of the Tweed.
Assuming the fact of the popularity as out of dispute, the causes
of it in which by the influence of which it may have been produced will
be a topic by no means void of instruction, with
reference to the question concerning whatever the effects, good
and bad, that may reasonably to be expected from its introduction into
Scottish practice.
