§. 4. Fourth cause of the attachment of Englishmen to the
institution of Juries – favourableness propensity of prospect of impunity afforded by this part of the
judicatory to give impunity to various descriptions divers classes of
delinquents.

It is a curious remarkable circumstance, a circumstance of
peculiar felicity peculiarly singularly favourable to the credit popularity of this institution
that its even its bad qualities points contribute are continuing along with
its good ones to the production of this effect.

Various classes of delinquents may be observed mentioned will presently be brought to view
who would be sure stand little chance of acquittal liberation
under a permanent and responsible Judge or bench of Judges, but who will
behold a very consolatory and encouraging prospect
of favour and consequent acquittal success in the some prejudice
or sinister propensity, natural to ephemeral judges of this description, a
propensity which the irresponsibility of their situation leaves
them at liberty to indulge without hazard and with
full effect.

In favour of delinquency as such no man can
ever stand up with any prospect of success. There Whoever
therefore has an interest in seeing this the design or that law
defeated or its efficacy diminished, must betake him
for the promotion furtherance of any such design betake himself
to some indirect and unconspicuous course, and
to this design Jury trial, it is evident, can not but
be favourable in the exact proportion to the degree of debility
which on the occasion in question it infuses into the nervous system of the law.
