Opposite as they in external appearance as this cause
of popularity is to the one first mentioned upon a
nearer inspection they will be found on many points
to coincide.
The influence of this the Jury-box popular mode of trial species of Judicature in
the whole fabric of the constitution has been already mentioned
as its chief excellence utility, and that an utility capable
of making abundant compensation for much worse
imperfections inconveniences than any of those which are inseparably
attached to it. the use of it.
But the very thing point in which this influence consists
is that of giving acting as a Source principle cause of debility
on the energies of a bad government whole nervous system to which
may be added and occasionally of some particular
parts of a government which is in the main a good
one.
In all constitutional and political disputes –
whether the dispute whatever be the cause subject matter and ground of
the dispute – in the case of a monarchy the title to
the crown, as between one competitor and another – or
a contest between the members of the government ruling powers with such part of the common people
as are attached to them on the one side and another
part portion of the people community on the other – the which
members of one of the contending parties, are all
of them, in so far as they are seen to act as such, delinquents
and those of the most atrocious criminal class in the eyes of
the other. In the eyes nomenclature of the party which has power happens to be in
possession of power on its side, the members of the opposite party are so long
as in pursuit of their designs they are seen to act, this malcontents, and in
proportion as they are seen to act, seditionists or traitors,
