If the circumstances tie by which the affections of the
man of law are attached to this system were composed
of those essential parts of it which are really
beneficial to the community, and to those alone, it
is to those really beneficial parts that the expressions of
his attachment – his elogisms would confine themselves.
In the indication given by him bringing these to view in the character of beneficial
features, commanding them intitled as such to calling upon the people for
their inviolable persevering attachment and support, he it would be his
care at the same time to bring to view those others of
an opposite complexion for the purpose of casting on those
on whom it depends, to ease the system of the .

Accordingly if in any other system course of procedure, he behold
a system which, being altogether free from the inconveniences
inseparable or not inseparable, attached in practice fact to
the system of procedure of which Jury trial forms a
part, might at the same time be substituted to the
Jury trial system in the far greater part of the whole number
individually taken of causes suits instituted, substituted to
the Jury syste trial system, and that without diminishing
in any degree the good effects benefits that depend upon it,
it would be his care in speaking of the two systems modes
to render to each its due: in bestowing his elogisms
on the Jury system Jury trial, he would be careful not to suppress
the mention either of those inconveniences which might
be separated from that system of procedure, or of that other
system in which no such inconveniences are to be found.
