The parallel comparison might be carried pursued in throughout much further
but than to for the present purpose, this much will
at least be deemed sufficient.
Whatsoever an other ends are necessary to justice
either the Courts of natural procedure either possess them
already in virtue of the unfettered latitude of authority, incident attached
to that unsophisticated mode of procedure, or might which the
Jury-trial inedification of technical procedure either
does not possess them at all, or possesses them in
but in some inferior footing, or in some inferior degree; or else in at the worst
might be made to possess them on a footing and in a degree more
advantageous than any in which those same and they could be
by that modification of the technical procedure
of which Jury trial seems the principal and only honest truth is the characteristic feature.
Under these circumstances, when praise is
to be bestowed, these Jury-trial Courts are the
only Courts in which the matter worthy of praise
is discovered. observed Of the Courts of Natural procedure
nothing is not the any slightest mention is made in
any such view.
But are they Not that they have passed unheeded altogether.
No: when censure is the thing to be bestowed for the
purpose of censure they are brought to view without
difficulty: and then it is that it is that the above and all
other these points of perfection inseparably and exclusively attached to that mode of procedure being bound in alms,
the imperfections or supposed imperfections which
if not are attached to them only by accident, are
brought to view as if in common with these belonging to its essence.
