Interest of the people deemed to be sacrificed, enter to the
indolence of one set of lawyers or the avidity and ambition of another the others.
In the Resolutions so unanimously acceded to by
Faculty, and in the eagerness ardency of the zeal manifested by those
Faculty Resolutions may be seen a certificate of the utility
of the innovation institution in its expected state, to the Faculty
and in the same ardency may be seen a certificate
of its mischievousness to the people, in their quality
of clients and suitors.
By its expected state, I mean,
or as an additional encumbrance adventitious load added to the existing load of
factitious delay vexation and expence attached to
the established modification mode of the technical
system of procedure
Mounted upon the natural system mode of procedure
already so happily in use in Scotland already with so happy an effect applied in Scotland to the great majority
of causes – mounted upon that only honest system
and reserved for the case when the reality need of the demand
for it on part of justice has been manifest by
appeal or otherwise, such causes as in their undivided the complexity of
which renders the application of it to them impossible in their undivided state
state are too complex to admitt of it being previously
analysed into their component parts, it would in
reality, be that blessin the country that blessing which
in its intended state all is so falsely pretended to be.
