Of two modes of influence – both of them in every frequent
exercise – the influence of understanding over understanding,
and the influence of will over will – the one
and the only one of which on the pres occasion in
question the exercise and prevalence is desirable, is
the influence of understanding over understanding. The
influence which naturally and commonly exercised on the occasion in question by
the Judge the opinion of the Judge over the Jury the verdict of the Jury is
the influence of the understanding over understanding: and this
is the influence which the torture has not any tendency
to encrease. The influence and the only influence which
it in the nature of the torture to encrease over the Jury over that verdict
is the influence of will over will, the same sort of pecuniary interest or any other of those motives
the operation of which is
which are commonly comprized under the name of corruption.
This Of this influence the effect operation where it has any
is always in the case on the occasion in question in direct opposition
to that of the only desirable influence, the supposed operation
of which thus numbered is ascribed by the Reverend Doctor among
the beneficial effects of this species of torture thus applied:
and this upon the whole so that upon at the upshot, so far from being contributory to
the good effect he speaks of, it can not act produce any consequence of its own without being
contributory producing to the directly contrary effect. Suppose no
corrupt interest in engaged in the action, the victory belongs falls to the most obstinate
obstinate self-sufficient and self-willed . Suppose a corrupt interest, a victory
over eleven honest men is in the power of the one corrupt.
