Of two modes of influence – both of them in every frequent
exercise – the influence of understanding over understanding,
and the influence of will over will – the one
and the only one of which on the pres occasion in
question the exercise and prevalence is desirable, is
the influence of understanding over understanding. The
influence which naturally and commonly exercised on the occasion in question by
the Judge the opinion of the Judge over the Jury the verdict of the Jury is
the influence of the understanding over understanding: and this
is the influence which the torture has not any tendency
to encrease. The influence and the only influence which
it in the nature of the torture to encrease over the Jury over that verdict
is the influence of will over will, the same sort of pecuniary interest or any other of those motives
the operation of which is which are commonly comprized under the name of corruption.
