Constitut. Code
In this directive rule is implied another of which may also be
considered as being of the a historical or physiological cast belonging to the history
& physiology of the human mind. In the mind of every man, and thence
in the mind of every public functionary are two interests
continually in operation: 1. his individual interest: 2. his
share in the universal interest. These his interests are
liable and apt to be in a state of almost continual conflict opposition:
to this opposition, to substitute coincidence and
identif is the object of the above directive rule.
The two interests are and to be in opposition conflict when the
tendency of one of them being to prompt a man to the performance
of a certain act, the tendency of the other is to prompt
him to that which in the way of interdictiveness as the
say is the opposite act: in coincidence, when it is to one
and the same act that they concurr in prompting him.
