Received , by which under any degree of corruption
a Judge may be is justified at the hands of the aristocratic
of the Pub Opinion Tribunal, and to a small extent at do of democratic do.
§. Influence of Monarchy on the state of Judicature.
In a Monarchy – corruption on the part of the Judges
corruption has place universally: on the part of almost all Judges
at all places at all times: corruption, practiced upon
the largest scale, and with perfect impunity, and
assurance of impunity: of impunity perfect as against
punishment at the hands of the legal sanction,
and to a vast extent as against punishment at
the hands even of the social sanction.
From At the hands of the Monarch, and those who are in favour
with him, every man for himself and all those with
whom he is connected in the way of interest or sympathy
– every man, and and the Judge whoever he is
as much as any man, has everything to gain,
the external instruments of felicity hope
in every one of their shapes, and in every one of
them to an indefinite amount, and so has he, and to no
inconsiderable amount to lose or otherwise suffer.
In the track of partiality and injustice thus produced
by corruptive influence there are certain lengths
which, this under the fear of the social sanction Public Opinion Tribunal
particularly the democratic section of it, this or
that Judge will refrain restrict himself from going: but in that same track there are
certain lengths which no Judge will even ref restrict
himself from going. What should make him? From yielding to
his way everything to gain,
for not yielding he has
more or less to fear.
