If with relation to the individuals on whom it operates
the power of in question were un confined to the placing of them
in the several situations which have been rendered objects
of such general desire vast would be the influence exercised by
it. But in relation to no small portion of the aggregate
cannot probably mean the largest proportion to it is
the power of displacing with reference to those same objects.
But in comparison of the power of displacing the power of
placing with reference to the the object in question
is comparatively trifling. Th In the mere power of placing
no power of punishment is included – In the power of
displacing with reference to a situation of the kind in
question is included a power of punishment, far superior
in its to any power which commonly exercised
under that name. Excesses would be denied, and on
that account interdicted by the Bill of Rights would be
a pecuniary punishment by which in England a man should be deprived
of a situation equally in value to the least valuable
situation on any of the Government Boards.
Punishment so called Not till after trial, nor without
conviction can any punishment which is called punishment
be inflicted. No conviction no trial is requisite in the this other
case: without opportunity of defence, without expence to the eye
of the Public Opinion Tribunal, without a moment's warning it may be inflicted at any time.
