Constitut. Code
Art. 9 2 The Prime Minister having forthwith immediately
after rece receipt of such reference, appoints a day for a
hearing judicial hearing of the case: that is to say either
in person by himself in pers or by a person deputed by him
for the purpose, or by the Minister Justice Minister.
Art. 10 3 Of such hearing the place will in ordinary
cases be some Justice-roomChamber, and performed with open doors. But for special
cause of secrecy the hearing may be kept secret information
of such secrecy being given to the Legislature who will proceed
thereupon on the principles laid down in Ch. 6. § respecting
secrecy-requiring sittings.
Art. 11. The Superordinate though without authority
from the so appointed Judge he cannot dislocate, may
by written instrument pronounce the suspension of the supposed inapt
suspend the Subordinate so informed pronounce Subordinate, declaring the suspension to be in his opinion necessary, and stating the time during which the suspension is to it is
to continue, and every in case of necessity may in like manner
renew such suspension any number of times for the same or any lesser length of
time, until judgment shall have been pronounced
Art. 12. To In case of deficiency in respect of intellectual
or active aptitude, resignati on the part of a public
functionary by resignation may made by him and accepted he may be saved
from the enquiry for the purpose dislocation: and thence for
the enquiry made, as above, for that purpose: Not so in the case
of deficiency in respect of moral aptitude. For the sake of example,
the lot of intentional must be kept from being confounded with
that of unintentional evildoers.
