Box 39 contains material relating to Bentham's massive, unfinished Constitutional Code, which contains the most important statement of Bentham's theory of constitutional democracy. This was the major work of his final years, and was addressed to 'all nations and all governments professing liberal opinions', as when drafting the Code he had been encouraged that it could be adopted in Portugal, Greece, and a number of South American nations.

The material is arranged as follows:

  • Folios 1 to 15 : Leading principles of a constitutional code for any state [c.1823]
  • Folio 16: Constitutional Code—rudiments [1823]
  • Folios 17 to 25 : Constitutional Code—Ministers jointly [1823]
  • Folios 26 to 27 : legislator’s inaugural decision, sent to Leicester Stanhope [1824]
  • Folios 28 to 275 : Constitutional Code—Ministers collectively [1824-27]
