Constitutional Code

Exceptions excepted Altogether indefensible is official emolument as in every shape
not at the time with official service, performed in
the situation to which the emolument is attached. This money
stiled extravasated emolument, or remuneration.

The following are the distinguishables in which emolument
thus attached to official situations has been found
to shew itself.

I. Reward Pecuniary remuneration reward in a state manner in which it is extravasated
in respect of time.

1. Pensions of retreat payable after possession had of the office
or of some office in the same department for a certain length
of time.

1. Pensions in case of payable for the life of the functionary in the
of relative inaptitude sufficiently proved by sufficient evidence.

1. Superannuation pensions: pensions paid to the functionary
during his life on the supposition of a diminution of appropriate aptitude presumption of inaptitude
on his part produced by advanced age.

2. Pensions of retreat payable for the life of the functionary after continuance in the office
from which the retreat is made or in some other
office or of offices belonging to the same department rising one above another on the
scale of emolument belonging to the same department.

II. Pecuniary remuneration applied in a manner in which it is
extravasated in respect of place.

3. Pensions to widows, payable to the widow of the de
functionary for the time of her life in case of his being in a married state having
a wife living at the time of his death

4. Pensions for life payable to children or other relative of the function
from the time of his decease. Those in the Army
Establishment of England are stand designated by the name
of Compassionate allowances
