Whatever error it thence exposed to in this case
is less than in non other case.
II. Non-proportionality: want of proportion between reward and
service: the reward not being capable incapable of being, in respect of
its quantity, adjusted in each individual instance, to the
quantity of and value of the service.
1. In the case of natural honor authoritatively augmented
after being judicially conferred, the reward of itself, adjusts
itself, and with the in each individual instance, and
with the utmost nicety, to the quantity and value of the individual
service: the consequence is that in each
instance if before the eyes of the same individual two or
different services, both of them such as he is in his own view
of the matter is capable of rendering, happen to offer present
themselves to his chance at the same time, the greater
reward being by the supposition attached to the greater
service, the greater a service is that which will obtain
his preference: whereas in the opposite case, while had the reward been the same for both the lesser
might would have obtained his preference: and the difference
between the value of the one and the value of the other
would be lost to the public.
