1824 Nov. 9
Constitutional CodeCh. XI Ministers jointly
§. 11 Remuneration Factitious honor.

Rationale

3. II. Its nature

3. Factitious honor or dignity has place in so far as
in consequence of some visible testimony of approbation favour
bestowed upon by an individual person upon another sentiments
of respect towards him are entertained in relation to
him by the members of the community at large by individuals persons at large. It is a
factitious cause of factitious respect.

4. Two principal circumstances there are on to which the effects
produced by it are in a principal degree indebted for
the existence. These are 1. its being conferred by arbitrarily
conferred; 2. its being conferred by an individual hand a principal functionary
by the hand of a distinguished individual in the state.
It may indeed as well be said Say at once, by the Monarch:
for if this there be an any instances there be in which it has been conferred
by any other hand or hands they would be found and in any other form of government or by any
other hand or hands, they would be too few, are
too narrow in extent and too few in number to be
on this the present occasion worth notice to a purpose such as the
present.

5. Neither in In idea neither nor in and possibility are either of these circumstances
are inseparable from it. But as they in practice they
never are or scarce ever have been, they may, without danger of misconception,
be and accordingly on this occasion will all
along be, on spoken of as if included comprehended in its essence.

6. By arbitrarily conferred understand here as in
the text, other Art. 28 otherwise than judicially conferred.

7. This As to conception of the instruments by means of which it this factitious honor and dignity endowment has been
conferred created and conferred, for examples see the Text – Articles 29. 30. 31.(a)

Note (a)
So nearly synonymous are as to the two words honor
and dignity so near are they to the being synonymous – so faint the shades of difference by which they
are distinguished – that without any considerable danger of misconception they
may be employed perniciously: On some occasion the one will appear most appropriate; on others, the other. to explain An explanation of the difference belong would be a
work rather for the grammarian than for the legislator: and would take up more room than it is worth would pay for.
