Constitutional Code
To blindness to deafness, to palsy, to painful disease
in all its shapes – to all those casualties of which relative
and even compleat inaptitude and incapacity with
relation to profit-seeking occupations is the consequence,
not less exposed is the fun non functionary than the functionary.
If any case situation there were in which the demand for
a pension of retreat in case of
incapacity through infirmity, bodily or mental could
have place, it would be that of a Judge. What? said
the author of these pages once to the present President of the United
States, should a Judge become blind or deaf, or bed-ridden
would you have him cut and leave him to starve?
Why not? answered the Citizen of the political state Commonwealth
which is a patron for all others: and then came forth
in substance the instructional matter which has just been seen.
With respect to means of livelyhood present and future, certain and contingent In the case of official as well as every other occupation
antecedently preparatorily to entrance each man from his own calculations,
and makes his choice accordingly: for the accuracy as to the making
of those calculations no one else other person has such serving inducements,
such well-adapted means: in case of miscalculation,
whether it be from imprudence or accident, no
reason can there be why the damage should be repaired
at the expence of the rest of the community the damage
should be repaired for the benefit in the case of the non- functionary
than in for that of the non-functionary.
