Art In the case of a justice of a Peace, it is
a declared maxim, that no such functionary is to be
punished for any thing he has done unless what he
has done, has been done with from compleat intention motives; unless

to the satisfaction of the Judge or judges of the King's Bench, it
has been by direct evidence proved to have been done from corrupt motives;
which in the cases of the greatest enormity, is
mainly impossible.

Art Now then as to the effect of this maxim
upon the number of the members, of whichmultiplicity in the case of
the Cabinet Council is composed. When, after a correspondently
long period of sufferance on the part of the whole community,
the mischiefs from the inaptitude of the functionary
has fuelled to a pitch no longer endurable —
instead of being eliminated out of this supreme Board
he is continued in it, invested with some Office, to
which not only money to vast amount in reality, and proven in appearance
is attached; the profession, be he who he may,
of that office being in that character admitted into the
Board: by which means the influence lost in fact is continued
Board thus rendered a sort of lay
stall upon which the rubbish of office, instead of being
carried clean out, is shot down. Nor is the euthanasia
thus afforded, altogether withoutthat which, in superior cases is justificative cause: for, how
ill soever the deceased has deserved of the people — of the ruling
one and thesub ruling few, the most unapt functionary
has, in every such instance, in so far as depends upon will,
deserved as well as the most apt.
