Ch. Judge Deputes permanent

Art. 8. When, in any Judicatory by any cause whatsoever a vacancy
has been produced in the office situation situation of Judge
principal in a Judicatory the Judge Depute permanent
if there be but one, or the senior in service as er Ch. XI. § if there be

Unless and until the vacancy is filled up by the presence
of a successor, occupies it, as to everything but the receipt exceptions excepted as per §. 1, but

points may, by a Judge Depute permanent or occasional
be referred to the Judge cognizance of the Judge principal: provided always that such reference be not suffered but it will be for the care of the Judge principal, and
that of his Judge Appellate that such reference be not made
to have the effect, of an engine of undue delay, vexation,
or expence.
