Box 41 contains material relating to Bentham's massive, unfinished Constitutional Code, which contains the most important statement of his theory of constitutional democracy. It was the major work of his final years, and was addressed to 'all nations and all governments professing liberal opinions', as when drafting the Code he had been encouraged that it could be adopted in Portugal, Greece, and several South American nations.

This batch of material mostly deals with the judiciary.

Volume I of Constitutional Code—part of the Collected Works of Jeremy Bentham—was published in 1983, edited by Professor Fred Rosen and Professor J.H. Burns.

The material is divided as follows:

  • Folio 1: To 'ministers collectively' [1826]
  • Folios 2 to 26: To the 'Judiciary collectively' [1823]
  • Folios 27 to 102: On the role of 'Judge Deputes' [1823-25, 1827, 1831]
  • Folios 103 to 203: 'Quasi-Jury' [1823-27]
  • Folios 204-528: Dealing with 'Judicial visitors, Government advocates, Immediate defenders of the helpless, Immediate registrars, Appellate judges, Professional lawyers, and the Justice Minister' [1823-32]
