Constitutional Code.

The rule in which any imperfection attached to it
will not improbably may naturally enough to a first view be seem to be that
on which it is most likely to manifest itself or deficiency.

First as to deficiency. Give no pay it may will be
said you will have no work: and the work you provide
is hard work, is assiduous work, and therefore hard work,
neither is it every body man that is fit for it.

The answer is grounded on experience: on experience
not only general but particular.

Even where were every power, and the high reputation which
a course of good conduct would attached to the exercise of it out of the question,
the distinction would of itself present no inconsiderable reward,
and a the reward of such a sort the desire of which affords
no inconsiderable mean presumption of that appropriate aptitude by which it
is merited.

But the power is of a kind, the exercise of which has
naturally acc
has for its natural accompaniment a highly agreeable sensation in no small degree
agreeable to every mind which feels in itself an aptitude
for the exercise of it. Witness the English Small Debt Courts
called Courts of Conscience. Field of jurisdiction narrow in the extreme: numbers
in a judicatory large consequently the power of each a
proportionally small fraction: pay, none. Nor is gratuitous
arbitration within example: in which case the field of jurisdiction confined to a
single suit without example.

In the present instance the two opposite circumstances
are all conjoined the opposite of the two former those just mentioned
concurr: 1. Logical field of jurisdiction boundless; the power
an integer: the whole of it in a single hand.

Another testimony is that which is afforded by The Danish Courts of seats of cheap justice
called Conciliation Courts afford another example testimony. Field
of jurisdiction much more ample indeed than that of the English
Courts of Conscience but still are narrow in comparison of that
which belongs the jurisdiction to the here
proposed judicatories
under or that can too if those among whom the power is divided the number is not inconsiderable: and there too the service is gratuitous.
