Art 1 – Deputes is matter

§. 4 Remuneration

Art. 1 Question. Is it not unlikely that there will be any want of apt persons and in such
numbers, be willing to serve in this capacity, with such
responsibility, without pay, and paying so close an attendance.

Answer. By no means. They will have in this case –
all of them, the chance of succeeding to the salaries as well
as honorable situation of Judge: of Judge immediate
in the first instance, and after that, of Judge appellate.

Art. 2 But without any such emolument or the chance of it,
examples of persons filling the situation of Judge, may be
found anywhere. ☞ 1. England. 2. French Parliaments. Danish Conciliation Court.

1. Even in England, with the exception of a few recently
established instances, the functions of Justice of the Peace
have been and are exercised all over the Country, in some
instances even with loss, others without profit or loss and
where there is profit, without any that can be regarded as
an adequate inducement by men differently circumstanced
in regard to income from a very moderate quantum, up
to enormous opulence.

Art. 2. True it is that in this instance to the functions
purely judicial they added others of a very miscellaneous
nature, some of them to which the power of migration, with the disposal of public money
or considerable powers in other shapes are attached. True
it also is, that by men in this situation, no more business
in this shape is done than what at the moment it suits their inclination
to take, nor at any other times than those in which it
suits their inclination to take it.
