power attached to that situation is minute indeed, when compared
with that which has place in the present case: and
the honor which, if aptly exercised, cannot fail to be attendant
on it.

are to be found designated by various names; amongst
others are those of "Small debt Courts:=" and "Courts of Conscience".
In all these Courts, the power is fractionalized: the fraction,
in some instances minute; and attached to it in no instance, emolument
in any shape, attached to it or in expectation of rising to any
higher situation. True it is, that, neither in this case is the attendance
compulsory: on the other hand, minute is the highest importance
of the causes, which in these cases, come under cognizance:
ordinarily nothing beyond causes concerning debt in
the most ordinary shapes and generally speaking to no higher
amount than forty shillings: in no instance to any higher
amount than forty shillings five pounds.(a)

Art. 7 (a) Lately, in Newcastle, a design an aid was set on foot, for terminating
causes of a certain class, mostly if not exclusively
mercantile, by popularly-elected & unpaid Judges. The design
failed, but not for want of persons ready to accept the office.
On the contrary the failure was produced by the great multitude
of apt persons who were desirous of accepting it.
