Art. 13. On this occasion, look to the Instructional or Exemplificational Danish Reconciliation Courts.

This Institution took its rise in the year 1798 and
since that time has been an object either of imitation or at
least of attention, in every civilized part of Europe, England
excepted.

Instructional Exemplificational
Art. 13 In this case no power properly speaking, no coercive
power has ever yet been exercised. The Judges give their opinions
the Suitors conform to them or do not conform to them as
they think proper. Plaintiffs being under the obligation of bringing
their causes in the first instance to these inexpensive Judicatories, but
with liberty after hearing the opinion of these Judges, to resort
to the ordinary & expensive ones. The power, such as it is, say
rather the influence, is in this case fractionalized, covers no part of
the penal field, and very far from the whole of the civil field.(a)

Instructional Exemplificational
Art. 11. Professional lawyers were from these Judicatories
excluded: excluded not only i the character of Judges, but as
assistants to the parties. By the exclusion of all factitious expence,
it may be imagined how prodigious must have been the
accession made to the total number of causes of Suits, compared with the
number that had place under the ordinary system. True
it is, that, under the ordinary system, an accession to the number
can not but be made, nor that an inconsiderable one,
where by the number of those suits in which the power of the law is thus
converted into an instrument of depredation & oppression in other shapes.
But the number is unquestionably
much
greater of those, in which
by the terror of the
expence, the plaintiff
who has a just demand
is prevented from making
it.
