For the purpose of this such resistance

In all the departments of the State Government, for the purpose of
such resistance, and to give colour to it, as if derived from
regard, not only to particular and private but also to public interest, two propositions are want to be advanced and inculcated: and the
more thoroughly conversant those by whom they are advanced
are of the truth of untruth of them the more strenuous
and impatient of contradiction is the energy with which
they are advanced.

True as is this state of the case in regard to all other
departments, it is naturally in more particular degree true in the case
of this department: from the importance of the business of the
Judiciary department it derives its plausibility and power persuasion of
persuasion, and, from the business and nature of the profession
in which the arts of exaggeration and deception in all shapes
are in constant exercise, it derives whatsoever force and
influence depends upon the hands by which in the war of
words the weapon is wielded.

The assertions in question are these two:

1. On the two terms in question no apt hands will be capable
of being engaged

If on these same terms any hands are capable of being
engaged, they will be unapt hands, by which the trust will be
absurd, and by whom it would not have been accepted but
for the purpose and with the intention of abusing it.

To the first of these objections the answer comes now to be
given.

Ch. XII § Securities for ap Judges' &c Securities for appropriate aptitude.
