§. Occasional Deputes.

Occasional Deputes. The occasional Depute would
in effect be, in a large proportion, be in effect so many
Arbitrators or Umpires or Arbitrators. If on the occasion of each suit the choice were
to be made of them, by the Judge and without Appeal acting in secret, a
door would thus be constantly wide open to corruption, and the
confidence of the public would neither be possessed not united
by the system of judicature. But for this function under the here proposed system
no person could ever be proposed, whose claim to exemption
from sinister laws would not be scrutinized into with
the utmost freedom, by interrogations from as many as
desire to put them, with the utmost freedom of observation comment
on the result. In such a state of things that
any individual should ever be found in whose eyes it
should be worth while to expose himself to the ignominy
that would be sure to follow upon an unsuccessful attempt
upon the probity of the Judge, does not seem is an incident that does
not seem likely to be of frequent occurrence: still
less that a Judge should be found imprudent enough
to listen lend himself to it. For suppose the bargain made, the
corrupt instrument of one of the parties, located in the
situation of a Depute occasional for the hearing of that
suit: what would it the confidence were he
to pronounce the unjust decree? Above him would be the
Appellate Judicatory to review it: and on one side of him
would be the Quasi Jury with the of to pass condemnation
on it by their recorded , and with the unorganized
other Committee of the Public Opinion Tribunal
body of Judicial Visitor to assist in making known painting
the whole colour of the case terms to the eyes of that Judicatory
by whose decision the ultimate fate of the suit
would be determined.
