Art. 3. Why thus call upon the Judge to locate then
to divest himself of his authority?
Answer. Reasons.
1. To provide serve as a remedy against actually existing inaptitude on the part of absolute
or comparative, on the part of the Judge. Give the
to the parties the power of location, they will be better satisfied
than if it were in the hands of the Judge: and so likewise will
be the public: in a word, by and with this power, all
parties concerned will be better satisfied, than without it.
2. To seek as a preventive remedy against inaptitude.
unless On the occasion of the application made for their location
unless some incontestable or proved fact be alledged as the
ground of the ap it, the an effect of any such application will
be apt to be the giving intimation of disapprobation as
being entertained in relation to the conduct in character
of the Judge. Any such imputation a Judge will naturally
be anxious to avoid. Here there will be an
motive for good conduct on the part of the Judge and in
particular, a spur to a general habit of closeness of attention.
