Constitutional Code. Ch. XV Judge Deputes Occasional

A Causes by either of which it may though
of a mutually opposite nature, it may happen to a suit
to be presented to a Judge principal as fit to be committed
to the cognizance of a Judge Depute occasional, are these
two: namely, the that is to say – 1. its belonging to the class of those which are
at the same time of the most frequent occurrence, and at the
same time, the most simple in their texture: 2. its
being in its individual texture in an extraordinary
degree competent: when simplicity is the cause, the suit
in question is one of an indefinitely large one :
when complexity, it is some one suit singly and
separately considered.

Of sort of suits which are stand of the interest of
simplicity
at the same time highest on the scale of simplicity
and at the same time of in that of frequency of occurrence,
examples are the following: namely

1. Suits commonly called Small Debt suits: suits, in
which the subject most in demand is money in a small
sum, and the efficient cause of either one or other of the
sorts of agreement of the entering into which the instances are most
numerous: such as the agreement to pay money in return
for goods, sold and delivered, for useful labour performed
&c.

2. Simple vituperation, expressed by vague generalities,
unaccompanied with specific defamation – or say imputation
of criminality or immorality in any specific shape.

3. Simple corporal vexation productive of pain or uneasiness
by afflictive conduct, unproductive of any perpetual or permanent
vexation: such as tat produced by the extirpation, debilitation, or
deterioration of any member or organ of the body.
