Constitutional Code. Ch. XV Judge Deputes occasional
§
Instructional

In this state of things, however, in study of giving to the
suddenly inflowing twenty simple vituperative and simple corporal
vexation suits together the precedence over the suits which
they find entered on the paper, there may be a use in the Judges
pulling out for the cognisance of the Judge Depute occasional the
for the next days hearing out of the original batch the Small Debt suits, and out of the
sudden influx the simple vituperative suits. Why? Answer.
Because in the case of small debt suits are less less
than suits of any other description apt to give existence
to contrariety of evidence, and length of counter-interrogation:
accordingly those of which in the English Small Debt Courts 20 or 30 are commonly
heard and determined in the course of one and the same
sitting are of this description.

As between two lots of relief, the relief of two persons
from a delay of a given length, and the relief of one person from the
a delay of twice that length which is the most valuable. Suffering The
circumstances of the two individuals not by to be
the answer seems to be – neither is most valuable: in respect
of rules they are stand both of them upon exactly the same
level.

To constitute any decided difference, connected to the parties in the one case
connected there need be a great number of persons, by line of the
same degree of closeness in the way of self-regarding interest or sympathy:
or in the case where the subject matter of demand is a portion of its
matter of wealth by that individual those individuals whose pecuniary circumstances
by being on the pursuers side are least affluent, the delay will be most afflicted, his
relief for that same delay, in the higher degree valuable.
