II. Evils correspondent and opposite to the collateral ends end of
justice: mensuration of expence of justice in the shape of delay, vexation
and pecuniary expence
1. Vexation needless quantity of expence or both produced by the multitude
of the actually serving Jurymen in each suit.
2. Much greater vexation and expence produced by
the still greater multitude of the obligatorily attending Jury in out
of whom in which suit the actually serving are taken drawn.
4 3. The vexation and expence and mischievous complication produced by the operation
called challenging: an operation the object of which
is to expunge of the keep excluded out of the actually
serving list Quasi Jurymen such number of the obligatorily
attending list as are on one side or other suspected
of partiality in favour of the respective adversaries. Of the
inadequacy of this remedy instead will indication be made a disease.

4. Vexation abundant is the state of confinement
and confines to which in case of disagreement the whole twelve are kept
unsolved: is enforcement which has for its object
