Constitutional Code
So much are for laws: now as to Judges: If under the system frame of
government substantive law in question the laws were having for their end in view the
greatest happiness of the greatest number were in their nature
and operation had any conducive to the production of that effect, the greater the aptitude
of the set of judicial functionaries to the purpose of giving execution
and effect to those same laws the more effectually conducive
would their endeavours be to the maximization of that same happiness.
So On the other hand if under the frame of government in
question, the laws having for the end in view the greatest happiness
of those the comparatively few bearing a part concerned in the making of
them had for their object also accordingly for their end in view the maximization of sacrifice of the universal
to that same particular and sinister interest, the greater
the aptitude of the set of functionaries in question with relation reference
to the purpose of giving execution and effect to those same laws
the more effectually conducive to the minimization of that
same universal happiness will their endeavours be, if so it
be that their desires take that same course. But under the
frame of government in question that same course is the one
course which the desires of those same functionaries have at all
times taken, it never having at any time been in the nature of man possible that they
should have taken any other: for in the framing of the laws in
question they are the persons who at all times have had the principal
share: and accordingly it is to them theirs is the particular interest
to which in the framing of them the greatest regard has been paid,
and to which the in the largest proportion the sacrifice of the universal interest
of the many has been made.
It is by for them and for by them that by the people at large conformity the rule of action to those who
to the rule of action has been kept in such a state that to the rest of the
people knowledge of it and obedience to it be is impossible, to the proper and
that for the pretence of procuring obedience for it their pay may profit might be as great as
possible: it is by them and for them that to parties having need of this official service access to their persons has inexorably been denied, to the end that the bud of delay, vexation and expence out of which with the proportionable profit which they have had the effrontery to extract and their
confederates in the other departments be to suffer them support them in extracting a profit might be maximized encreased.
