Ch. Quasi Jury
§.

In the formation of a Quasi Jury System impartiality
two ends or objects require to be kept in view: impartiality
and appropriate moral aptitude and appropriate
intellectual aptitude: appr on the present occasion the mode
of the appropriate in the shape moral aptitude more particularly requisite is impartiality
may be designated by one word impartiality: the shape in which the appropriate
intellectual aptitude is particularly desirable is
that of appropriate knowledge and sound judgment in relation to the perception
of
actual state of the law in its several branches, and
the principles on which with relation to the greatest happiness
of the greatest number it is grounded: in a word
the body of law taken in all its parts, together – enactive
part expositive part and rationale. In regard to impartiality
the object is to obtain it when it exists already
and to secure it against its being to made to give place to
the opposite bad its mischievous opposite quality. In regard to intellectual aptitude
– diffusion of legal instruction it is rather a
collateral good desirable or rather flowing of itself from the
system rather than any part of the direct object of it.

Impartiality In regard to impartiality the objects subjects of
reference are 1 the Judge 2 and the parties. Of these the main
object is the Judge: the Judge being this functionary being the
person in whose instance to secure rectitude of decision
and so far depends upon to that end impartiality as towards
both parties it is the endeavour by means of this institution to ensure.
