§. 2. Functions.
§ Communication function Quasi-Juror Checks.
Art. 1. This function a Quasi Juryman is not only in all
cases authorized, but in a certain case bound to exercise. For deficiency in appropriate intellectual
or active aptitude, no man in any public situation in into which
his entrance was not spontaneous but compulsory can
or he may with any good effect be made punishable. But
should it ever happen, that in the exercise of his function
in the presence of a Jury, the misconduct should on the part of the Judge any
such misconduct should have place in any such shape
as to render manifest its having a deficiency in
respect of appropriate moral aptitude for its cause, and if
at the same time this should be manifest with eyes of
that in such sort that it can not but be manifest in
the eyes of the Quasi-Jury, in this case every Quasi-Juryman
who to suffer without comment on his part suffers
it to pass and be productive of its intended effect, is an accomplice
with the evil doing Judge and will as such be
punishable.
§. 2. Functions.
Art. 1. To Judicial Visitors belongs of right
the auditors functions, as in the case of Quasi-Jurors.
Art. 2. So, but though at the discretion of the Judge, the inspective,
the interrogative, and the commentative: and, before
to the exercise of those functions by those same functionaries, in so far
as may be without obstruction to the business, he will
rather give no encouragement than hindrance.
Art. 3. To them belongs not the Operative function
nor yet the Appeal warranting: and in them these may be seen seen
the the principal differences between their functions and those
of the Quasi-Jury.
