Proceedings in the Examination made of proceedings
Art. 1. Necessary to the giving execution and
effect by a Judge to any portion of law in favour of a suitor on
either side of the suit say in the first place on the pursuers side is the
union of will and power with relation to the several
states of things which follow namely
1. Intellectual possession of the means of proof with
relation to the his right or title to the service prayed by
him.
2. Possession of the means of execution.
3. Appropriate application of the means of execution to that
same purpose to the purpose of giving effect to the decision
by the giving effect to which that same service would be
rendered.

Art. 4. Art. 4. For avoidance of inconsistency and insincerity
Where, in a cross cause suit growing out of
that in which he was originally Pursuer, a the party whose
interest he had espoused Government happens to become Defendant,
the Public Pursuer General will, in general, take such Defendants
act on behalf of such Defendant: but, for the more effectual
avoidance of such inconvenience, the Judge, in case of need,
will order otherwise.
Art. 5. Except it be in a case in which as per § 3. Government is
on one side of the Art. 5. suit and the Sub Legislature on the other. Acting on behalf of any Sub-Legislature
a the Public Pursuer is acting on behalf of Government.
