§. 7 Postulative function

Art. 3. Much of Procedure. as follows to the postulative The service is supposed
to be as yet unperformed: object of the reward, procuring the performance of it
in that individual instance.
By the postulant, in terminis proposed in this case
is by appropriate invitation. In it are contained Particularly amongst others, the particulars following: namely
1. Service needed.
2. Occasion of the need.
3. Reward proposed – its quality.
4. Its quantity.

Stated thereupon by the Public Defender are either Advocate of the helpless in his opinion, imparting
1. Simple approbation or acquiescence;
2. Simple disapprobation – in taking or
3. Modified Modified approbation.
From silence on his part acquiescence is inferred.
4. In case of disapprobation or modified approbation, his
reasons.

From silence after due notice, his acquiescence is infeasible inferred.

The Judge thereupon either refuses or issues decrees
Appropriate evidence of the need of the reward Of the need of the reward, the case,
it is presumed if it has not already furnished, or will have
been made to furnish.

The Judge thereupon either refuses all the reward simply,
or issues decrees fixing it, and adopting for publishing the invitation
with any Art. 4. The such alterations, if any, as he thinks fit.

Art. 4. The service rendered, the postulant proposes
in terminis the imperative decree, ordering the Registrar
to make payment:
by execution of which the reward, according to the nature of it, is
to be conferred.

Art. 5. Exceptions excepted, proceedings are in this as in all
other cases open: as per Ch. XII Judiciary collectively §. Publicity &c.
Exception Cause for temporary secrecy in in this case may be – danger, lost, from publicity, a delinquent
divers effective facility for means of escape.
