Instructional.

When in relation to any offence merely public
or publico-private which has been committed, or said to
have been committed information for the first time reaches
the ears or the eyes of a Judge it may have been through
the medium and or intervention of ten intended persons,
or without in an immediate way having passed through any such medium,
and in this latter case the individual by
whom it the information is communicated to the Judge will be either
an alledged percipient witness or an alledged simply
indicative witness: percipient if so it be that as far in so far as
of the alledged facts spoken of by him there are any which he
states as having come under presented themselves to the cognizance of his
own senses: indicative in so far as he speaks of
those in no otherwise than by on report from others.
Unless the door be of the Judicatory be kept open to the
and kept open to the informer, the individual
injured and the Official person who on behalf of the
government is or should be Pursuer, may each of them in
the case that belongs to him, or even both together by
confederacy, deprive the public of the benefit of the
preventive efficacy of the punishment, and thus secure
not the sought for profit other would afford encouragement and
effective incitement to criminality mischievous acts in
any shape.

If in the case of a purely public offence
no pursuit could take place but in so far as carried
on by the Official pursuer say the Pursuer General
a an unlimited power of sitting pardons for all the whole list of such such offences what would
by that simple omission be virtually in effect placed in his
hands: a power beyond comparison greater than of pardoning
after conviction.
