If in the case of a publico-private offence the
like negligence were to have had place the encouragement
incitement to criminality would not be capable of
being altogether so effective, because the obli in so far
as actually borne the burthen of making compensation
operates of course in the character of punishment: and
the obvious presumption is – that a person who has
sustained an injury will not in general be disposed
to give up an forbear obtaining compensation for
it in whatever way it may appear to him to be
obtainable. Deplorably inadequate however would this
means of repression be if in any a case of serious injury
to the individual all danger of punishment was beyond
the burthen of compensation were removed done away, and the
charge of preferring and following up the demand for
compensation were at the same time left to bear exclusively
on his unaided face of the individual injured.
The case in which this deficiency is most conspicuous
is that of the sort of personal corporal injury which exceeds
in magnitude all other personal injuries put together,
that is to say homicide. For depredation, or vengeance
an act of homicide is committed on the person suppose
of a widower or a widow having in each case a
family of children all in tender age: the object one subject of the
immediate injury is extinguished by the crime: the
object of the brutalitious injury were by their condition
in life incapacitated from pursuing with effect any demand
of compensation with by suit or without suit.
